Shopify is a tool for creating and hosting websites. When you visit our website, Shopify collects your IP address and information about the device and browser you are using. Shopify also analyzes visitor numbers, visitor sources, and customer behavior, and creates user statistics. If you make a purchase on our website, Shopify also collects your name, email address, delivery and billing addresses, payment data, and other data related to the purchase (e.g., phone number, amount of sales made, etc.). For analysis purposes, Shopify stores cookies in your browser.
For details, please refer to Shopify's privacy policy: https://www.shopify.de/legal/datenschutz.
The use of Shopify is based on Art. 6 (1) lit. f GDPR. We have a legitimate interest in the most reliable presentation of our website. If appropriate consent has been requested, processing is carried out exclusively on the basis of Art. 6 (1) lit. a GDPR and § 25 (1) TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.
3. General information and mandatory disclosures
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.
When you use this website, various personal data is collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.
We point out that data transmission over the Internet (e.g. communication by email) can have security gaps. Complete protection of data against access by third parties is not possible.
Information about the responsible party
The responsible party for data processing on this website is:
Designmachine XYZ GmbH
Ziegelleite 2b
85110 Kipfenberg
Phone: +49 846525586 21
Email: hello@designmachine.io
The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).
Storage duration
Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing ceases to apply. If you assert a legitimate request for deletion or revoke consent to data processing, your data will be deleted, unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, deletion will occur after these reasons cease to exist.
General information on the legal basis for data processing on this website
If you have consented to data processing, we process your personal data on the basis of Art. 6 (1) lit. a GDPR or Art. 9 (2) lit. a GDPR if special categories of data are processed according to Art. 9 (1) GDPR. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49 (1) lit. a GDPR. If you have consented to the storage of cookies or to access to information in your terminal device (e.g. via device fingerprinting), data processing is additionally carried out on the basis of § 25 (1) TTDSG. Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 (1) lit. b GDPR. Furthermore, we process your data if this is necessary for the fulfillment of a legal obligation on the basis of Art. 6 (1) lit. c GDPR. Data processing can also be carried out on the basis of our legitimate interest pursuant to Art. 6 (1) lit. f GDPR. Information on the respective applicable legal bases in each individual case can be found in the following paragraphs of this privacy policy.
Note on data transfer to the USA and other third countries
Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data can be transferred to these third countries and processed there. We point out that a data protection level comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It cannot therefore be ruled out that US authorities (e.g. intelligence services) process, evaluate, and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out before the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 (1) LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING SERVES THE ASSERTION, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 (1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 (2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their workplace, or the place of the alleged violation. The right to lodge a complaint exists regardless of other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of data to another controller, this will only take place if it is technically feasible.
Information, correction, and deletion
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient, and the purpose of data processing and, if applicable, a right to correction or deletion of this data. For this and for further questions on the subject of personal data, you can contact us at any time.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
- If you have lodged an objection pursuant to Art. 21 (1) GDPR, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
SSL or TLS encryption
This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Encrypted payment transactions on this website
If, after concluding a fee-based contract, there is an obligation to transmit your payment data (e.g. account number for direct debit authorization) to us, this data is required for payment processing.
Payment transactions via common payment methods (Visa/MasterCard, direct debit) are exclusively carried out via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
In the case of encrypted communication, your payment data that you transmit to us cannot be read by third parties.
4. Data collection on this website
Cookies
Our internet pages use so-called "cookies". Cookies are small data packages and do not cause any damage to your terminal device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your terminal device. Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or an automatic deletion is carried out by your web browser.
Cookies can come from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).
Cookies have various functions. Numerous cookies are technically necessary because certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.
Cookies that are necessary for carrying out the electronic communication process, for providing certain functions requested by you (e.g. for the shopping cart function), or for optimizing the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6 (1) lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimized provision of his services. If consent for the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 (1) lit. a GDPR and § 25 (1) TTDSG); consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.
You can find out which cookies and services are used on this website in this privacy policy.

This website uses Usercentrics' consent technology to obtain your consent for the storage of certain cookies on your terminal device or for the use of certain technologies and to document this in compliance with data protection regulations. The provider of this technology is Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, Germany, Website: https://usercentrics.com/de/ (hereinafter "Usercentrics").
When you enter our website, the following personal data is transferred to Usercentrics:
- Your consent(s) or the revocation of your consent(s)
- Your IP address
- Information about your browser
- Information about your terminal device

Furthermore, Usercentrics stores a cookie in your browser in order to be able to assign the given consents or their revocation to you. The data collected in this way is stored until you request us to delete it, you delete the Usercentrics cookie yourself, or the purpose for data storage ceases to apply. Mandatory statutory retention obligations remain unaffected.
The Usercentrics banner on this website was configured with the help of eRecht24. You can recognize this by the eRecht24 logo appearing in the banner. To display the eRecht24 logo in the banner, a connection to the image server of eRecht24 is established. Your IP address is also transmitted here, but it is only stored in an anonymized form in the server logs. The image server of eRecht24 is located in Germany with a German provider. The banner itself is exclusively provided by Usercentrics.
The use of Usercentrics takes place to obtain the legally required consents for the use of certain technologies. The legal basis for this is Art. 6 (1) lit. c GDPR.
Order processing
We have concluded an order processing contract (AVV) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that it processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

This data is not merged with other data sources.
This data is processed on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically flawless display and optimization of their website – server log files must be recorded for this purpose.
Request by email, telephone or fax
If you contact us by email, telephone or fax, your request, including all personal data resulting from it (name, request), will be stored and processed by us for the purpose of processing your inquiry. We will not pass on this data without your consent.
The processing of this data takes place on the basis of Art. 6 para. 1 lit. b GDPR, if your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; consent can be revoked at any time.
The data you send us via contact inquiries will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage ceases to apply (e.g., after your request has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected.

Google Tag Manager
We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies into our website. Google Tag Manager itself does not create user profiles, does not store cookies, and does not perform independent analyses. It is used solely for the management and deployment of the tools integrated through it. However, Google Tag Manager collects your IP address, which can also be transmitted to Google's parent company in the United States.
The use of Google Tag Manager is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in a quick and uncomplicated integration and management of various tools on their website. Consent can be revoked at any time.
Google Analytics
This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables the website operator to analyze the behavior of website visitors. The website operator receives various usage data, such as page views, time spent on pages, operating systems used, and user origin. This data is assigned to the respective end device of the user. No assignment to a user ID is made.
Furthermore, with Google Analytics, we can, among other things, record your mouse and scroll movements and clicks. Google Analytics also uses various modeling approaches to supplement the collected data sets and employs machine learning technologies in data analysis.
Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.
The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. Consent can be revoked at any time.
The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

Furthermore, targeted advertisements can be displayed based on user data available to Google (e.g., location data and interests) (audience targeting). As website operators, we can quantitatively evaluate this data, for example, by analyzing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.
The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. Consent can be revoked at any time.
The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

Google Conversion Tracking allows Google and us to recognize whether the user has performed certain actions. For example, we can evaluate which buttons on our website were clicked how often and which products were viewed or purchased particularly frequently. This information is used to create conversion statistics. We learn the total number of users who clicked on our ads and what actions they performed. We do not receive any information that allows us to personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

According to this agreement, we are responsible for providing the data protection information when using the Facebook tool and for the legally compliant implementation of the tool on our website. 6. Plugins and Tools
YouTube with extended data protection
This website embeds videos from the YouTube website. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the extended data protection mode does not necessarily exclude the transfer of data to YouTube partners. Thus, YouTube establishes a connection to the Google DoubleClick network, regardless of whether you watch a video.
As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to directly assign your surfing behavior to your personal profile. You can prevent this by logging out of your YouTube account.
Furthermore, after starting a video, YouTube can store various cookies on your device or use comparable recognition technologies (e.g., device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness, and prevent fraud attempts.
Further data processing operations may be triggered after a YouTube video has started, over which we have no control.
The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's end device (e.g., device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.
Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.
Google Fonts (local hosting)
This site uses so-called Google Fonts, provided by Google, for the uniform display of fonts. The Google Fonts are installed locally. A connection to Google servers does not take place.
Further information on Google Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy?hl=de.
7. E-commerce and Payment Providers
Processing of customer and contract data
We collect, process, and use personal customer and contract data for the establishment, content design, and amendment of our contractual relationships. We collect, process, and use personal data about the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6 para. 1 lit. b GDPR.
The collected customer data will be deleted after the order has been completed or the business relationship has ended and any existing statutory retention periods have expired. Statutory retention periods remain unaffected.
Data transfer upon conclusion of contract for online shops, retailers and goods dispatch
If you order goods from us, we pass on your personal data to the transport company entrusted with the delivery and to the payment service provider commissioned with the payment processing. Only such data as the respective service provider requires for the fulfillment of its task will be disclosed. The legal basis for this is Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. If you have given corresponding consent according to Art. 6 para. 1 lit. a GDPR, we will pass on your e-mail address to the transport company entrusted with the delivery so that it can inform you about the shipping status of your order by e-mail; you can revoke your consent at any time.
Data transfer upon conclusion of contract for services and digital content
We only transfer personal data to third parties if this is necessary in the context of contract processing, for example, to the credit institution commissioned with payment processing.
No further transfer of data takes place, or only if you have expressly consented to the transfer. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.
The basis for data processing is Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.
Credit Checks
For purchases on account or other payment methods where we make advance payments, we may conduct a credit check procedure (scoring). For this purpose, we transmit your entered data (e.g., name, address, age, or bank details) to a credit agency. Based on this data, the probability of a payment default is determined. In the event of an excessive risk of payment default, we may refuse the respective payment method.
The credit check is carried out on the basis of contract fulfillment (Art. 6 para. 1 lit. b GDPR) and to avoid payment defaults (legitimate interest according to Art. 6 para. 1 lit. f GDPR). If consent has been obtained, the credit check is carried out on the basis of this consent (Art. 6 para. 1 lit. a GDPR); consent can be revoked at any time.
Payment Services
We integrate payment services from third-party companies on our website. If you make a purchase from us, your payment data (e.g., name, payment amount, bank details, credit card number) will be processed by the payment service provider for the purpose of payment processing. The respective contractual and data protection provisions of the respective providers apply to these transactions. The use of payment service providers is based on Art. 6 para. 1 lit. b GDPR (contract processing) and in the interest of a smooth, convenient and secure payment process (Art. 6 para. 1 lit. f GDPR). If your consent is requested for certain actions, Art. 6 para. 1 lit. a GDPR is the legal basis for data processing; consent can be revoked at any time for the future.

Data Processing
For communication with our customers, we use, among other things, online conference tools. The specific tools we use are listed below. If you communicate with us via video or audio conference over the internet, your personal data will be collected and processed by us and the provider of the respective conference tool.
The conference tools collect all data that you provide/use for the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, the beginning and end (time) of participation in the conference, the number of participants, and other "contextual information" related to the communication process (metadata).
In addition, the tool provider processes all technical data required to conduct online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.
If content is exchanged, uploaded, or otherwise provided within the tool, it will also be stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.
Please note that we do not have complete control over the data processing operations of the tools used. Our options are largely determined by the business policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the respective tools used, which we have listed below this text.
Purpose and Legal Bases
The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). If consent has been requested, the relevant tools are used on the basis of this consent; consent can be revoked at any time with effect for the future.
Storage Period
The data directly collected by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal retention periods remain unaffected.
We have no influence on the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.
